Terms and Conditions

These General Terms and Conditions (“Terms”) govern the contractual relationship between:

(“We”, “Us” or “Seller”)

and you, as the buyer (“You” or “Customer”).

These Terms are issued in accordance with Section 1751(1) of Act No. 89/2012 Coll., the Civil Code, as amended.

They regulate the mutual rights and obligations arising in connection with or based on a purchase contract (“Contract”) concluded through the e-shop operated on the website www.bjarkan-style.com (“E-shop”).

Information on the processing of personal data is contained in the Privacy Policy, available at [link].

The Terms form an integral part of the Contract.
The Contract and the Terms are concluded in English.

We may amend these Terms unilaterally. Such amendments do not affect rights and obligations arising during the validity of the previous version.

1. Definitions

1.1 Price – the amount payable for the Goods
1.2 Delivery Price – the amount payable for delivery, including packaging
1.3 Total Price – Price + Delivery Price
1.4 VAT – value added tax under applicable law
1.5 Invoice – tax document issued for the Total Price
1.6 Order – your binding proposal to conclude a Contract
1.7 User Account – account created based on provided data
1.8 Customer – a person purchasing Goods through the E-shop
1.9 Goods – products offered in the E-shop

2. General Provisions

2.1 Goods may only be purchased through the E-shop interface.
2.2 You are obliged to provide true and accurate information when placing an Order.
2.3 Product reviews shown on the E-shop are verified by linking them to specific orders.

3. Conclusion of the Contract

3.1 Contracts may be concluded only in English.
3.2 Contracts are concluded remotely via electronic communication.
3.3 To conclude a Contract, you must submit an Order including:

  • selected Goods

  • Price, Delivery Price, payment and delivery method

  • identification and contact details (name, address, email, phone)

3.4 Before submitting the Order, you may review and modify entered data.
The Order is completed by clicking “Order with obligation to pay” and confirming acceptance of these Terms.

3.5 Upon receipt of the Order, we will confirm it by email.
The Contract is concluded upon Order confirmation.

3.6 We may refuse an Order if Goods are unavailable or quantity limits are exceeded.
3.7 In case of an obvious pricing error, we are not obliged to deliver Goods at the incorrect price.
3.8 Upon conclusion of the Contract, you are obliged to pay the Total Price.

4. User Account

4.1 A User Account may be created by registration.
4.2 Account data must be accurate and updated.
4.3 Login details must be kept confidential.
4.4 The account is personal and non-transferable.
4.5 We may cancel an account if unused for 2 years or in case of breach.
4.6 Account availability is not guaranteed continuously.

5. Prices and Payment

5.1 Prices are shown in the E-shop and in the Order.
5.2 Prices include VAT and all statutory charges.
5.3 Payment methods:

  • Online card payment via [Shoptet Pay]

5.4 An electronic invoice will be issued after payment.
5.5 Ownership of Goods passes upon full payment and receipt.

6. Delivery and Transfer of Risk

6.1 Goods will be delivered within 3-10 days by selected method - depends on availability - mentioned in description of each item.
6.2 Delivery is available within [territory – e.g. EU / Czech Republic].
6.3 Delivery time is indicative.
6.4 Upon receipt, you must inspect packaging integrity.
6.5 Failure to accept Goods may result in storage fees.
6.6 Re-delivery costs due to Customer reasons must be reimbursed.
6.7 Risk of damage passes upon receipt.

7. Defective Performance and Complaints

7.1 We guarantee that Goods are free from defects upon delivery.
7.2 Rights arising from defects are governed by applicable law.
7.3 Complaints may be submitted via email or in writing.
7.4 You may request repair, replacement, price reduction, or withdrawal.
7.5 Complaints are resolved within 30 days unless otherwise agreed.
7.6 Consumers have a 24-month warranty period.

8. Withdrawal from the Contract

8.1 Consumers may withdraw within 14 days without giving reason.
8.2 Withdrawal may be made by email or written notice.
8.3 Goods must be returned within 14 days of withdrawal.
8.4 Refunds are issued within 14 days after receipt of returned Goods.
8.5 Return costs are borne by the Customer unless otherwise stated.

9. Consumer Dispute Resolution

9.1 We are not bound by any codes of conduct.

10. Final Provisions

10.1 The Contract is governed by Czech law.
10.2 Communication is conducted electronically.
10.3 Force majeure releases both parties from liability.
